Please review the following terms that govern your use of our website (“KynniBlakeInc.com”)and purchase of services from Kynni Blake Inc. Please note that your use of our Site and payment to Kynni Blake Inc. constitutes your agreement to follow and be bound by those terms (the ‘Agreement’).
Below are the Kynni Blake Inc. (“KB Inc.”, “KBI”, “We”, “Us”, “The Designer”) terms and conditions. The terms and conditions are provided to manage expectations and services, and protect both you “The Client” and “Kynni Blake Inc.”
It is important that you (“The Customer”, “The Client”) take time to read thoroughly read and ensure you fully understand these terms and conditions and their significance before you contract Kynni Blake Inc. for any project.
Please also note that from time to time Kynni Blake Inc. may need to alter these terms and conditions & prices.
In such cases, notification will be set to you via email.
Payment & Refund Policy
“The Client” agrees to pay:
– 50% non-refundable deposit of the quoted amount when project is finally quoted, before the project is started.
– All following payments must be made with project paid in full per payment agreement.
Unless other payment arrangements have been made.
Booking in Advance
25% non-refundable deposit is required for down payment. Additional 25% is due to get your project started. The final 50% is due when all revisionS have been completed and work is verbally approved.
– All projects below $300 must be paid in full.
– All unpaid quotes are cancelled on specified due date, if the required deposit and/or payment is not received by the due date, unless advised otherwise.
PLEASE NOTE: All deposits are non-refundable. Kynni Blake Inc. Terms & Conditions serves as your contract and once your invoice is paid, this serves as your agreement to all of the terms of service listed here.
If a project is cancelled by “The Client”, for whatever reason, the deposit will serve as a cancellation fee.
If the “The Client” changes their mind for whatever reason, this deposit is non-refundable and the initial 50% deposit is forfeited and acts as a cancellation fee.
Once an invoice is sent and is not paid within 7 business days, your site will be temporarily suspended, and all other any other projects will be on hold, unless other arrangements have been made.
After 30 days of non-payment of the final invoice being sent, your website will be completely suspended and we will charge a restoration fee + final payment in full before.
Print Design projects such as Business Cards and/or Flyers MUST be paid in full before sending off to print. Projects including Print Projects will be sent to print after final invoice is paid. After project is sent to print, there is no refunds unless the printer is at fault.
No final artwork or files without watermarking will be delivered until final invoices are paid in full.
Draft files (revision files, unselected logo proofs, premium paid fonts and themes,) remain the property of Kynni Blake Inc.
Completion & Client Response
Graphic Design Projects completion time varies from: 1-4 weeks.
Web Design Projects completion time varies from 2-16 weeks.
“The Client” must provide all information requested for project in a timely manner. If “The Client” fails to respond for whatever reason, we will mark the project complete again forfeiting the initial deposit.
We understand some information takes time to acquire to email us, which we respect and will reschedule the start date of your project. Please All keep in contact and advise us that you need more time to gather information for the project. If you pay a deposit or full payment and 30 business days have passed with no communication, understand your deposit/full payment will be forfeited.
After 30 days, If we are contacted in effort to complete former project, the remaining deposit, if one was paid must be paid to resume services, in addition to a 26% interest fee.
For ALL Projects: all material, products and other information that was requested in your essential email must be submitted before project is completed. If requested information is not submitted once completed, You, “The Client” is responsible for uploading and/or adding this information and/or products to your website. If you would like us to do this, you will be quoted and/or invoiced for this as a new project, which much me paid, before all tasks are complete.
Revisions: You will receive a numerical limit of revisions in every project. Once all the revisions are used, a fee will occur for any additional revisions after that. Once you have submitted all your revisions in your package and your project is emailed, or made live, the remaining revisions in which you did not use EXPIRE immediately. If you would like us to add any information and/or products received after this point to your website, you will be quoted and/or invoiced for this as a new project, which much me paid, before all tasks are complete.
The production of any original design work automatically deems Kynni Blake Inc. the author and therefore the owner of such work.
All projects are not to be advertised via social networking sites before completed. That is breach of contract and projects can be left as is as well as forfeiting your deposit.
All Retainer Package fees must be paid by the 1st of the month for any updates, maintenance or support provided during the following month. Any update, maintenance and support requests made by a clients not under a Retainer Package will be billed at $26-60/hour, depending on the request.
We do not guarantee any specific position in search engine results for your website. We perform basic search engine optimization according to current best practice, unless SEO services have been purchased.
We shall not be liable for any loss or damage which you may suffer which is in any way attributable to any delay in performance or completion of our contract, however that delay arises.
We reserve the right to subcontract any services that we have agreed to perform for you as we see fit.
We (and any subcontractors we engage) agree that we will not at any time disclose any of your confidential information to any third party.
You are responsible for maintaining your own backups with respect to your website and we will not be liable for restoring any client data or client websites except to the extent that such data loss arises out of a negligent act or omission by us. (Unless you are under any of our Maintenance & Support Packages)
Ownership of Domain Names & Web Hosting
We will supply account credentials for domain name registration and/or web hosting that we purchased on your behalf when you reimburse us for any expenses that we have incurred.
We do not conduct business at any capacity on the weekends.
We have the right to decline any project at any moment for any reason and refund you the deposit if work has not been started.
